Terms of Service

What you can expect from Kapture, what we expect from hosts, and how plans, refunds and albums actually work. Written to be read, not to be survived.

1.This agreement

These terms are between you and Kapture. By creating an account, running an event, or joining one as a guest, you agree to them.

If you are setting up Kapture for a company, a venue or a client, you are agreeing on their behalf and confirming you are allowed to.

2.What Kapture is

Kapture gives your guests a camera in their browser and collects what they shoot into one shared album. There is no app for them to install and no account for them to create.

We provide the tool. What happens at your event, who you invite, and what you do with the photos afterwards is yours.

3.Accounts

You need an account to host. Keep your password to yourself. Anything done from your account is treated as done by you, which is why two-factor verification is worth turning on.

Every account gets one free event, for up to four guests, kept for four weeks. Beyond that, events run on a paid plan.

Accounts are for adults. If your details change, keep them current, because that is where refunds and reveal notifications go.

4.What hosts are responsible for

You chose the guest list and shared the code, so the event is yours to run. That means:

  • Telling your guests that photos are being collected and shared, and that a host can see them.
  • Having the right to invite the people you invite, and to share whatever the album ends up holding.
  • Handling requests from your own guests. Someone who wants their photo removed should be able to reach you.
  • Deciding what is acceptable at your event, and rejecting what is not.

We cannot see who is in a photograph or whether they agreed to be. That judgement is yours.

5.What you may not do

Do not use Kapture for anything unlawful, and do not use it to collect or share:

  • Sexual content involving children, in any form. This is the one thing we report rather than merely remove.
  • Content that harasses, threatens, defames or is designed to humiliate somebody.
  • Photographs taken where people have a clear expectation of privacy, or without consent where consent is required.
  • Anything infringing somebody else's copyright or other rights.

Do not attempt to break, overload or work around the service, including the guest limits, the capture pool, or the access rules protecting other people's events.

Photos are screened automatically for explicit content before anyone sees them. We may also suspend an event or an account that breaches this section, without notice where the breach is serious.

6.Plans and payment

Plans are priced by the number of guests, with optional add-ons for video and unlimited captures. Prices are shown on the pricing page in South African Rand, including any applicable tax.

Payments are handled by Paddle, our reseller and merchant of record. Your card details go to Paddle and never to us. Paddle's terms apply to the payment itself.

A plan is bought for an event, and a plan you have bought but not used stays on your account until you use it.

7.Refunds

If your album was never downloaded and holds fewer than fifty photos, you can cancel from your event dashboard for a full refund. No email, no argument. The button is there.

Once an album has been downloaded, or has passed fifty photos, the plan has done its job and is not refundable.

Deleting an event does not refund it, and does not give back a free event that has been used. The dashboard says so before you confirm.

If something has gone genuinely wrong, write to support@kptr.co.za. We would rather fix it than stand behind a rule.

8.How long your album lasts

Event media, meaning photos, videos and voice notes, is permanently deleted once your plan's storage runs out. On a paid plan that is twelve months from the day the event was created. On the free event it is four weeks.

The free event is there to show you what Kapture does, not to store anything. Four weeks is enough to come back for the album and not enough to be a backup. Run it on a paid plan if you want the year.

Download your album before then either way. The dashboard produces a ZIP you keep forever, and once the window closes the files are gone and we cannot recover them.

The demo event on our homepage is wiped daily and is not storage for anything you care about.

9.Who owns the photos

You do, and your guests do. Taking a photo through Kapture does not give us any ownership of it.

We need permission to store it, resize it, screen it and show it to the people entitled to see it, so you grant us a licence to do exactly that, for as long as we are hosting the album, and no further. We do not use your photographs to advertise Kapture, to train anything, or for any purpose beyond running your event.

10.Availability

We work to keep Kapture up, particularly while events are running, but we do not promise uninterrupted service. Networks fail, phones fail, and venues have bad signal. The camera queues shots taken offline and uploads them when the connection returns, which handles the common case but not every case.

Kapture is provided as it is. We do not warrant that it will be free of faults or that it will suit a particular purpose.

11.Liability

If we get something wrong and it costs you money, our total liability is limited to what you paid us for the event in question.

We are not liable for indirect or consequential loss: lost profit, lost opportunity, or the value you place on a photograph that did not upload.

Nothing here limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud. If you are a consumer, your statutory rights under the Consumer Protection Act stand regardless of anything in this document.

12.Ending it

You can delete your account whenever you like from account settings. It removes everything, immediately and irreversibly.

We may suspend or close an account that breaches these terms, or where we are required to. Where it is fair to do so, we will tell you why and give you a chance to put it right.

13.Changes to these terms

We may update these terms as Kapture changes. The date at the top moves when we do, and we will email hosts about anything that materially affects them. Continuing to use Kapture after a change means you accept it.

14.Governing law

These terms are governed by the law of South Africa, and the South African courts have jurisdiction over any dispute.
